  • Solar Market Development Act (Solar Tax Credits):

    • Summary of Provisions: Providing a tax credit for photovoltaic and solar thermal systems for New Mexico taxpayers (residents and businesses), equal to 30% of the installed cost minus any applicable federal credits, up to a maximum of $9000 in credits per system. Credits are proposed to be available for 10 years. It is also proposed that taxpayers can carry over the credits from year to year if their tax liability is not large enough to absorb the full amount of credit in the first year.
    • Status (SB 269): PASSED! First passed Senate Conservation Committee, Senate Finance, Senate, House Tax & Revenue, then onto final vote on the House Floor.
    • Status (SB 495): Passed House Business and Industry, House Tax & Revenue, rolled in House Omnibus Tax Bill (HB 82, ...), passed House, Passed Senate Finance. Omnibus Bill ran out of time and did not pass.


  • Renewable Energy Production Tax Credit Rate

    • Sponsor(s): Senator Carlos Cisneros
    • Summary of Provisions: Modifications to the Renewable Energy Production Tax Credits to support mid-scale wind (1-10 MW), such as single utility-scale turbines used to provide on-site (distributed) generation, a larger PTC value (2 cents/kWh instead of 1 cent/kWh) for Concentrating Solar Power projects, and allowing a wider range of taxpaying entities (businesses and other "personal income taxpayers") to co-invest in projects and utilize the credits. Presently co-investing entities must be "C-corps". This change would allow other entities, such as smaller local businesses, to co-invest, which could provide a very helpful source of support for many smaller projects.
    • Note: The original version introduced was accidentally lacking some of the provisions above due to a clerical error.
    • Status: DID NOT PASS. Passed Senate Corporations and Transportation, Senate Finance Committee, onto Senate Floor. It will also be proposed to amendment this bill into the House Omnibus Bill in Senate Finance.Omnibus Bill ran out of time and did not pass.


  • LAND, WILDLIFE & CLEAN ENERGY ACT

    • Summary of Provisions: Provides continued funding for the Clean Energy Grants Program which funds renewable energy and energy efficiency projects by state agencies, schools, municipalities, and tribes. Also funds conservation projects.
    • Status (HB 188): DID NOT PASS. Passed House Business & Industry Committee. Tabled in House Tax & Revenue Committee, awaiting re-hearing.
    • Status (SB 407): DID NOT PASS. Passed Senate Conservation, Senate Finance, Senate, now onto Tax & Revenue.


  • NM RENEWABLE ENERGY TRANSMISSION AUTHORITY

    • Summary of Provisions: Creating a new state authority that can plan, fund, and acquire land for electricity transmission and energy storage projects associated with renewable energy development. Eligible transmission projects must be designed to carry at least 30% renewable energy on average. Goal is to provide needed transmission capacity to allow further expansion of wind generation in New Mexico.
    • Status (HB 111): DID NOT PASS. Passed House Business & Industry Committee, House Tax & Revenue, House, now in Senate Finance.
    • Status (SB 317): DID NOT PASS. Passed Senate Judiciary Committee, Senate Finance, Senate Floor (with amendments), now onto House.


  • ADVANCED ENERGY PRODUCT TAX CREDIT ACT

    • Summary of Provisions: 5% tax credit for manufacturing of energy products manufacturing, including renewble energy and fuel cells.
    • Status (HB 128): DID NOT PASS. Passed House Business & Industry Committee, rolled in House Omnibus Tax Bill (HB 82, ...), passed House, now onto Senate Finance. Omnibus Bill ran out of time and did not pass.
    • Status (SB 254): DID NOT PASS. Passed Senate Corporations & Transportation Committee. Now in Senate Finance.


  • BIOMASS-RELATED MATERIAL TAX DEDUCTION

    • Summary of Provisions: Creates a gross receipts tax exception for equipment used for biomass energy conversion, and slightly broadens the definition of biomass sources eligible for the Renewable Energy Production Tax Credit
    • Note: The original biomass redefinition in this bill, which was flawed, is being amended so that it will not allow trees with diameters greater than 15 inches to be eligible, will not allow municipal waste to be eligible, and will guarantee that the primary use of the tax exempt equipment is biomass conversion.

  • SUSTAINABLE DEVELOPMENT TESTING SITE ACT

    • Summary of Provisions: Enables New Mexico to issue new regulations for special sites where sustainable technology can be tested.
